Rights Policy

This Rights statement discloses the creative rights management practices for cinestream.ca.

New Media Permissions
The film maker, studio, or distributor (the "Producer") presenting a film, documentary, show, or clip ("work") to Cinestream for inclusion in our titles library must hold the New Media rights authorizing internet distribution of the work. This includes, but is not limited to, all images, sounds, music, etc. featured in the work.

Sponsor-Pay License
Cinestream makes Producer's works available as downloadable files to Cinestream users. Cinestream collects sponsor's payments from sponsors, or their agents, on a per-title bases. We pass along the majority of the sponsor's payment ("Compensation") to Producer of the work sponsored for the exclusive right to distribute the work via the internet, retaining a percentage as our fee.

Union / Contractual New Media Royalties
Where the work was filmed using unionized labour (actors, writers, director, etc.), Producer is obligated to pay out a percentage of Compensation to these individuals, per the following schedule:

    Actors

  • SAG / AFTRA / ACTRA - Where the work features above-the-line (starring) actors that are members of the Screen Actors Guild, the American Federation of Television and Radio Artists, or the Alliance of Canadian Cinema, Television and Radio Artists the Producer shall pay these actors, collectively, a minimum New Media residual of 6% of Compensation received from Cinestream.
  • Directors

  • DGA Directors - Where the director of the work is a member of the Director's Guild of America, Producer shall pay the director a minimum New Media residual of 4.9% of Compensation received from Cinestream.
  • DGC Directors - Where the director of the work is a member of the Director's Guild of Canada, Producer shall pay the director a minimum New Media residual of 4.9% of Compensation received from Cinestream.
  • Writers

  • WGA Writers - Where the writer of the work is a member of the Writer's Guild of America, Producer shall pay the writer a minimum New Media residual of 4.1% of Compensation received from Cinestream. In the case of multiple writers, they shall share this sum.
  • WGC Writers - Where the writer of the work is a member of the Writer's Guild of Canada, Producer shall pay the writer a minimum New Media residual of 4.1% of Compensation received from Cinestream. In the case of multiple writers, they shall share this sum.

In short, if you as a Producer have benefited from union actors and writers, and a union director, you can expect to pay out about 15% of Compensation as residuals.

If the writer, actor, director, or other person involved with the work has a contract with Producer entitling them to a percentage or sum that differs from the amount he or she would be entitled to as outlined above, the greater of the two will be paid out.

The preceeding is a statement of CineStream policy on creative rights management. Where possible, we've tried to write it in plain English to make our policies easily undertandable. The above text is not a contract.
